Law  37/2007, of 16th November, on the re-use of public sector information, transposing Directive 2003/98/EC of the European Parliament and of the Council, regulates the re-use of public information available to administrations and bodies in which they are in the majority, that is, the right of all potential market players to re-use information from public authorities. According to these regulations, the Administration allows the reproduction, distribution and public communication of the work and, in addition, the transformation of the work to make derived works, provided that it does not contradict the licence or notice that a work may have and that it prevails.
In order to re-use the information, the following conditions must be met:
1. Do not distort the meaning of information.
2. Always quote the source of the information.
3. Mention the date of the last update of the information.
Furthermore, re-use can be limited by the protection of other priority legal assets, such as the protection of personal data, privacy or the intellectual rights of third parties. The reuse of works protected by intellectual property can be formalized through the use of open broadcasting licenses, such as those of Creative Commons, which cede certain exploitation rights of the works. In the contents where this type of license is applied, reuse is allowed under the conditions that are established there.
The use of logos, trademarks, shields and distinctive symbols of the City Council in publications and websites that are not affiliated or sponsored by this institution is not authorized in any case. These elements of corporate graphic identity are the exclusive property of the City Council and are protected by the applicable legislation.
